Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Alien Planet Games website at alienplanetgames.com and the games, applications, and services we operate (collectively, the "Services"), provided by Alien Planet Games ("Alien Planet Games," "we," "us," or "our"), an independent game studio based in Vancouver, British Columbia, Canada. By accessing or using our Services, you agree to these Terms.

Our games and product-specific terms

Alien Planet Games designs, publishes, and operates multiple games and applications — including NFTD (nftd.gg) — some of which have their own terms, privacy policy, and refund policy that apply specifically to that product and to any purchases made within it. Those product-specific terms govern your use of that product; these Terms apply to Alien Planet Games as a studio and to alienplanetgames.com generally. Where a product-specific policy conflicts with these Terms for that product, the product-specific policy controls.

Eligibility

You must be at least 13 years old to use our Services. Purchases may only be made by someone who has reached the age of majority in their jurisdiction (19 in British Columbia) or by a minor with the express consent and authorization of a parent or legal guardian. If you are a parent or guardian who permits a minor to use your payment method, you authorize all resulting purchases and are responsible for them. By making a purchase you represent that you have the legal capacity and authority to do so.

Accounts

Some Services require an account, which may be created and authenticated through a third-party provider (for example, Discord OAuth in NFTD). You are responsible for maintaining the security of any account you use to access our Services and for all activity that occurs under it. Notify us if you suspect unauthorized access.

Purchases and payments

Where our Services offer paid items, payments are processed by our payment processor, Stripe. Alien Planet Games is the supplier of record. Prices are listed in USD unless stated otherwise. Before you pay, the store displays the item, total price, and currency. Digital goods are typically delivered to your account immediately upon successful payment and, to the extent you consent to immediate delivery at checkout, are non-refundable except as required by law or as provided by the applicable product's refund policy. Product-specific terms and refund policies — such as NFTD's — apply to purchases made within those products. If a purchased item is not delivered to your account, contact us and you may cancel that transaction and receive a refund as provided by applicable law.

Virtual items

Any in-game virtual items or currency (such as NFTD's charges) have no cash value and are not redeemable for money. They are licensed to you for use within the applicable Service, not sold or owned by you, and are non-transferable except as expressly permitted by that Service's terms. We may modify, rebalance, or discontinue virtual items or features at any time.

Acceptable use

You agree not to cheat, exploit bugs, use automation or bots, manipulate leaderboards, or attempt to buy, sell, or trade accounts, virtual items, or currency outside of a Service's own systems. You agree not to misuse, disrupt, reverse-engineer, or attempt to gain unauthorized access to our Services. We may suspend or terminate access for accounts that violate this policy.

Intellectual property

All content, code, art, and trademarks in our Services are owned by Alien Planet Games or its licensors and partners. You may not copy, distribute, or create derivative works from them except as permitted by law or with our written permission. If you believe content in our Services infringes your intellectual property, contact us with details of the work and the allegedly infringing material.

Disclaimers

Our Services are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that our Services will be uninterrupted, error-free, or available at all times.

Nothing in these Terms excludes, restricts, or modifies any right, warranty, guarantee, or remedy that cannot be excluded under applicable law, including the British Columbia Business Practices and Consumer Protection Act. Where such rights apply, our liability is limited to the maximum extent that law permits.

Limitation of liability

To the maximum extent permitted by law, Alien Planet Games will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill, arising from your use of our Services. Our total liability for any claim relating to a Service will not exceed the amount you paid us for that Service in the 12 months before the claim arose.

Some jurisdictions, including British Columbia, do not allow the exclusion or limitation of certain damages or of liability for gross negligence, fraud, or personal injury; in those cases the above limitations apply only to the extent permitted by law, and nothing here limits your mandatory statutory rights.

Termination and suspension

We may suspend or terminate your access to our Services, with or without notice, for violation of these Terms or to comply with law. You may stop using our Services at any time. On termination, any licence to virtual items ends and, except as required by law or an applicable refund policy, unspent virtual items or currency are not refunded. Sections that by their nature survive termination (including Virtual Items, Disclaimers, Limitation of Liability, and Governing Law) continue to apply.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Effective" date above and, where appropriate, provide reasonable notice before the changes take effect. Continued use of our Services after changes take effect constitutes acceptance of the revised Terms.

Governing law

These Terms are governed by the laws of British Columbia, Canada, without regard to conflict-of-law principles. Any disputes arising from these Terms or our Services will be subject to the exclusive jurisdiction of the courts of British Columbia. If you are a consumer, this governing-law and venue clause does not deprive you of the protection of mandatory consumer-protection laws of your place of residence.

General

• Severability — if any provision is found unenforceable, the rest remain in effect.
• Entire agreement — these Terms, our Privacy Policy, and any applicable product-specific terms are the entire agreement between you and Alien Planet Games regarding our Services.
• Assignment — you may not assign these Terms; we may assign them to an affiliate or successor.
• Waiver — our failure to enforce a provision is not a waiver.
• Force majeure — we are not liable for failures or delays caused by events beyond our reasonable control.
